The article examines certain particularities of the Bulgarian procedural law concerning protective measures and Regulation No 1215/2012 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters. Pursuant to the second paragraph of Art. 2(a) of the Regulation, for the purposes of Chapter III, the term ‘judgment’ does not include a protective measure which is ordered by a court without the defendant being summoned to appear, unless the judgment containing the measure is served on the defendant prior to enforcement.
