Abstract

This article aims to present a critical view of Enrico Tullio Liebman’s theory of res judicata, especially with regard to its relevance to the Brazilian doctrine and the conformation of the institute to our legal system. The motivation behind this article concerns the fact that Liebman’s theses, although popular in Ibero-America, especially in Brazil, have not obtained the same recognition in other parts of the world, including Italy, his own country of origin.
