Abstract

The observed worldwide development towards electronic process and an electronic organization of the entire judicial system will certainly move forward in the near future. Their use bring along advantages such as less time and costs. But the new challenges of electronic processes raise important questions, if compared to the traditional methods, in terms of constitutional guarantees such as acess to justice, due process, equality between the parties, publicity, orality, free evidence evaluation, the right to a fair hearing and so on. The article intends to make a general overview of these subjects.
