Abstract

This paper aims at analyzing the way provisional execution of civil sentences proceed in México, the cases where it is allowed and the requirements that are imposed in order to enforced provisionally a judgment through this measure. Additionally, this paper examines the relationship between the trial court and the court of appeals when provisional execution is ordered and the way this decision may be subjected to the creation of a guarantee to cover all restitutions and damages.
