Abstract

This paper proposes a reflection about the Fundamental Norm of Brazilian Civil Procedure, a category inserted by the Civil Procedure Code of 2015. First, pro­poses the revocation of the classification informative and fundamental principles of the civil procedure. Second, identifies the hypothesis of formal, material and formal/ material fundamentality of a procedural norm. Third, demonstrates that the Funda­mental Norm may contain deontic structure of rule, principle or postulate. Fourth, examines the structuring, defining, integrative, interpretive and blocking functions of the Fundamental Norm. Lastly, stipulates criteria about the admission of special or extraordinary appeal in case of violation of a Fundamental Norm.
