Abstract

This paper aims to analyze the justification basis to limit the exercise of the right to appeal, specifically the normative basis for the prohibition of abuse of this right and, in the end, to proceed with an analysis of precedents of the Superior Court of Justice, with the aim of presenting the main difficulty for recognition and, therefore, the sanction correspondent to the abuse of the right to appeal.
