Voluntary jurisdiction and contentious jurisdiction
an artificial distinction in Brazilian Civil Procedure
Abstract
This paper describes the distinction between voluntary jurisdiction and contentious jurisdiction. The author explains the most important controversies which can be found among Brazilian scholars and demonstrates that this distinction is artificial in the context of Brazilian procedural law.
