The present article intends to analyse the mobilization of the theory of the dynamic distribution of the burden of proof to the Portuguese and Macanese Civil Procedure Law, from an iure condendo standpoint. Moreover, this article will provide an overview about the recent civil procedure code reform of Portugal of 2013, mainly from the “audiência prévia” (pretrial) standpoint, whose uttermost importance is deeply intertwined with theory of the dynamic distribution of the burden of proof.
