Abstract

The purpose of this paper is to gather a set of reflections on the monocratic judgment of the merit of civil appeals applied in Brazilian Higher Courts, based on the case law, pursuant by the art. 932, IV and V, of the Brazilian Code of Civil Procedure, and then to present some suggestions to improvement the monocratic judgment of the merit of the appeal brought to the Portuguese Higher Courts, regulated in the art. 656 of the Portuguese Code of Civil Procedure, stimulating debates on the subject and eventually inspires legislative changes.
