Abstract

The text is about the devolutive effect, focusing on the treatment that the Brazilian dogmatics granted to it, incompatible with the way it operates. The conceptual gigantism of the devolutive effect is criticized. Following, it tries to demonstrate that the conceptual problem gives rise to an operational problem, which can mean serious errors in the judgment of appeals
