Proposal of statutory modifications in the Brazilian Code of Civil Procedure and the Execution of Public Credits Act
Abstract
In Brazilian Law, most of the activity at the execution or enforcement phase is performed by the judge. Following the example of several jurisdictions, that has been some debate about decentralizing the execution, attributing to an “execution agent” many procedural legal acts that are usually subject of judicial concern. The current paper is a draft proposal of a bill amending the Code of Civil Procedure and other statutes to introduce the execution agent in the Brazilian legal system.
